If the NSA wanted to do that, they would have done it years ago with web cams.

That thing is, it's both an insanely blatant violation fo the 4th amendment, and very easy to detect it's happening by network snooping.

It does not really make any difference to the theory though. And again, it would be so easy to detect it was happening that they will very obviously not do it.

What MIGHT happen is they could snoop on data after it has left your house for normal purposes. For example if you were having a video chat, or playing DDR, then they might (in theory) record that.

But the idea that they would watch you while you think the system is doing nothing is just silly. Way too easy to detect.

I agree that it is silly. I wonder if there might have been some backlash by people worried they would not be able to play illegal games or modify the console. No one wants to be recorded playing DDR in their undies though.
