We met with several attorneys today who have much experience in class actions and major tort claims. Assuming the Triton Gang of Three absconds with the funds a class action would almost certainly not be practical nor legally certified for a number of reasons. Additionally, it would be unlikely that injunctive relief would be granted to stop Indiegogo from disbursing the funds on May 1st. A claim against Indiegogo would hinge upon proof that their conduct constituted some degree of "active" participation in the misrepresentation/fraud. Toward that end we are soliciting people to send sincere complaints to support@indiegogo.com and/or by surface mail to:

Several of you have already sent us confirmation of making such complaints along with a copy of the form letter received back from Indiegogo. (If you wish to help our e-mail is stoptriton@outlook.com.)
The best outcome, obviously, would be for Indiegogo to suspend the campaign and refund the money before it is disbursed on May 1st. If the campaign is permitted to continue and funds are released we intend to file a formal action for misrepresentation/fraud against Indiegogo in the Superior Court for San Francisco County. To do so we will need to have as plaintiffs people who have actually contributed to the campaign. If you or anybody you know learns of any contributors please try to have them contact us at stoptriton@outlook.com. They can continue to believe in Triton (and UFOs, Santa Claus and the Easter Bunny) but will be able to hedge their bets and get their money back and a share of any punitive damages awarded if we are successful.
We are deadly serious about pursuing this. By our analysis Triton has not only committed several acts of misrepresentation and fraud that have been relied upon by people to their detriment, but they also have breached their own obligations under the Indiegogo TERMS OF USE. If Indiegogo turns a blind eye to their conduct we do believe a jury will punish them by finding active participation in a fraudulent endeavor.
